TERMS OF USE


1. About these terms

These Terms of Use govern your access to and use of www.emladvisory.com (the “Site”), operated by Erin Lubowicz trading as EML Advisory (“EML Advisory”, “we”, “us”, “our”) [NAME ON THE LICENCE], holding [LICENCE TYPE AND NUMBER] issued in [FREE ZONE / EMIRATE], Abu Dhabi, United Arab Emirates.

By using the Site you accept these Terms. If you do not accept them, please do not use the Site.

2. Changes

We may amend these Terms at any time. The version posted here is the version in force. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

3. Using the Site

You may use the Site for lawful purposes only. You agree not to:

•          Use the Site in a way that breaches any applicable law or regulation

•          Attempt to gain unauthorised access to the Site, its servers, or any connected system

•          Introduce malicious code, or otherwise interfere with the Site’s operation

•          Scrape, harvest or systematically extract content, including for the purpose of training machine-learning models, without our prior written consent

•          Use the Site or its content to imply any endorsement, association or engagement that does not exist

We may suspend or withdraw access to the Site, or any part of it, at any time and without notice.

4. No advisory relationship

The Site contains general commentary and analysis on anti-money laundering, counter-terrorist financing, counter-proliferation financing, financial-crime policy and related regulatory matters. It is published for information only.

Nothing on the Site constitutes legal, regulatory, compliance, financial or professional advice, and nothing on the Site should be relied upon as such.

In particular:

•          No advisor-client relationship, and no lawyer-client relationship, is created by your use of the Site, by subscribing to our newsletter, or by contacting us through the Site

•          Content is general in nature and does not take account of your jurisdiction, institutional context, legal framework or specific circumstances

•          International standards, national legislation and regulatory practice change. Content is accurate to the best of our knowledge at the date of publication and may not reflect subsequent developments

•          Any views expressed are those of the author personally and are not attributable to any current or former employer, institution, delegation or inter-governmental body with which the author is or has been associated

You should obtain independent professional advice before acting on anything published here. Advisory work is undertaken only under a written engagement agreement.

5. Intellectual property

All content on the Site, including text, commentary, analysis, graphics, logos, and training materials, is owned by or licensed to EML Advisory and is protected by copyright and other intellectual property rights.

You may read, download and print content for your own personal or internal institutional use. You may quote short extracts provided you attribute them clearly to EML Advisory and link to the original page where reproduced online.

You may not otherwise reproduce, republish, distribute, adapt, or commercially exploit any content without our prior written consent.

6. Client Portal

The Client Portal is a restricted area made available to invited users only, for the purpose of accessing training and engagement materials.

Where you are granted access:

•          Access is personal to you and non-transferable. You must not share your login credentials.

•          Materials are provided under a limited, non-exclusive, revocable licence for use in connection with the relevant engagement or training programme only.

•          Materials may relate to specific jurisdictions or institutions and may be confidential. You must not disclose, publish, circulate or reproduce them outside the intended audience without our prior written consent, and you must comply with any confidentiality obligations attaching to the underlying engagement.

•          Materials are provided as delivered. They reflect the position at the date of the relevant session and are not maintained or updated.

•          We may vary, suspend or withdraw access, or remove materials, at any time.

If you believe your credentials have been compromised, tell us immediately at info@emladvisory.com.

7. Newsletter

You may subscribe to receive occasional updates. You can unsubscribe at any time using the link in any message, or by contacting us. Subscription is handled in line with our Privacy Policy.

8. Third-party links

The Site may link to third-party websites and resources. Those links are provided for convenience. We do not control, endorse, or accept responsibility for the content, accuracy or availability of any third-party site.

9. Availability and disclaimers

The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all representations, warranties and conditions, whether express or implied, including as to accuracy, completeness, currency, fitness for a particular purpose, and uninterrupted or error-free availability.

We do not warrant that the Site or any content is free from viruses or other harmful components. You are responsible for your own security arrangements.

10. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Subject to that, to the fullest extent permitted by law, we will not be liable for:

•          Any loss of profit, revenue, business, opportunity, goodwill or anticipated savings

•          Any loss or corruption of data

•          Any indirect or consequential loss

•          Any loss arising from reliance on content published on the Site

arising out of or in connection with your use of, or inability to use, the Site.


11. Indemnity

You agree to indemnify us against any claims, losses, liabilities and reasonable costs arising from your breach of these Terms, your misuse of the Site, or your unauthorised use or disclosure of Client Portal materials.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which forms part of these Terms.

13. Governing law and jurisdiction


These Terms, and any dispute arising out of or in connection with them, are governed by, and construed in accordance with, the laws of the Emirate of Abu Dhabi and the federal laws of the United Arab Emirates. 
The courts of Abu Dhabi Courts have exclusive jurisdiction, save that we reserve the right to bring proceedings in the courts of your place of residence or establishment.


14. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in force. Our failure to enforce any provision is not a waiver of it. These Terms constitute the entire agreement between you and us in relation to your use of the Site.
